New Intimate Images Laws in WA

New Laws in Western Australia regarding intimate images come into effect from 15 April, 2019, making it illegal to distribute an intimate image of a person without consent.  In the case of someone under the age of 16, the law states they cannot legally consent to an image of themselves being shared. Any person over the age of 10 who breaks the law can be charged with a criminal offence. All parents are encouraged to take the time to discuss this with their child/ren.

The key messages for young people are:

  • It is against the law to take, keep, send or ask for an intimate image of a person under the age of 18.
  • It is against the law to share or threat to share/distribute an intimate image of a person of any age without their consent.

There is an ever-increasing use of digital technology and social media, and child safety requires a consolidated approach from teachers, parents, friends and the community.  As such, Holy Cross College will be offering a parent information session next term (date to be confirmed).  This will be delivered by Legal Aid WA.  Legal Aid will also be delivering educational sessions to all students from Year 5 to Year 12 in Autumn Term.
